Welcome to Travels with Kirstie. These Terms and Conditions ("Terms") govern your use of our services and your relationship with us as your travel agency. Please read them carefully before booking any travel arrangements.

1. ABOUT US

Travels with Kirstie is an independent travel agency affiliated with Atlas Coast Travel Group, a registered host agency for cruise lines and travel suppliers. We are registered as a California Seller of Travel (Registration #2172267-70). We specialize in customized travel experiences including cruise vacations, resort bookings, and curated escapes.

2. SERVICES OFFERED

We provide travel agency services including, but not limited to:

  • Cruise line bookings and reservations

  • Resort and hotel accommodations

  • Vacation packages and group travel coordination

  • Travel planning assistance and destination recommendations

3. BOOKING AND RESERVATION

3.1 Booking Process

All travel reservations are made in your name on behalf of the applicable supplier (airline, cruise line, hotel, etc.). We act as your agent in arranging these services. A reservation is not confirmed until full payment is received and written confirmation is provided by the supplier.

3.2 Deposit and Payment Terms

Deposits required to secure reservations vary by supplier and are subject to specific cruise line policies. Final payment is typically due 45-90 days before travel, though this varies by supplier. Each cruise line establishes its own Final Payment deadline. You are responsible for meeting all payment deadlines. Failure to pay by the Final Payment deadline may result in automatic cancellation of your reservation without refund. All prices are subject to change until full payment is received.

3.3 International Credit Cards

International credit cards may only be used to make a reservation by telephone and if funds are converted into U.S. dollars for payment. Additional restrictions may apply. For select cruise lines, some reservation restrictions apply for customers with primary residential addresses outside of America's 50 states. Please ask for complete details.

3.4 Accurate Information

You are responsible for providing accurate and complete information (names, dates of birth, passport details, special requests, etc.). We are not liable for errors, omissions, or consequences resulting from inaccurate information provided by you.

4. CRUISE PRICING TERMS & CONDITIONS

4.1 Price Basis and Components

Sample prices are quoted in U.S. Dollars and are per person, double occupancy, unless otherwise noted. Prices do not include:

  • Airfare (unless expressly noted)

  • Gratuities and service charges

  • Travel insurance and coverage

  • Taxes and port fees (where applicable)

  • Personal expenses and onboard charges

4.2 Stateroom Category and Pricing

Your exact cruise price depends upon the selected stateroom category, day of departure, departure city, ship, and sailing date. Higher category staterooms will have increased pricing. Prices advertised online reflect the lowest available category for the specified sailing.

4.3 Fuel Supplements and Price Adjustments

Cruise lines reserve the right to add a fuel supplement at any time prior to departure. Possible fuel supplements are not included in sample prices advertised online. If instated, payment of fuel supplements would be due to the cruise line before departure. Cruise lines may also impose additional surcharges, taxes, or fees. All prices, offers, and dates may change without notice and are subject to availability.

4.4 Information Accuracy

We carefully monitor all information presented on our website. However, we are not responsible for any errors or omissions resulting in inventory, content, or pricing discrepancies. The details shown, including pictures and descriptions, are for informational purposes only. All information is subject to change without notice.

4.5 Offers and Upgrades

All offers and upgrades are only available for new individual bookings for selected dates, sailings, and stateroom categories only. Offers are subject to availability and are limited in quantity. Savings shown are based on cruise lines' published brochure rates. Upgrades are:

  • Limited in quantity and subject to availability

  • Capacity-controlled and may be withdrawn at any time

  • Not combinable with other offers, group rates, or group amenities

5. PASSENGER REQUIREMENTS

5.1 Government Identification

Passengers receiving special rates based on residency or age will be required to show a government-issued form of identification at the pier prior to boarding. Acceptable forms include:

  • Valid passport

  • Birth certificate and driver's license

  • Other government-issued identification

Failure to provide proper identification may result in denial of boarding without refund.

5.2 Contract of Carriage

For each cruise booked, it is your sole responsibility to comply with the rules and regulations of that cruise line and to be aware of the requirements set forth in each line's Contract of Carriage. The Contract of Carriage governs your rights and obligations as a passenger, including liability limitations, health and safety requirements, behavior policies, and dispute resolution procedures. You can request a copy of the applicable Contract of Carriage from us or contact the cruise line directly.

5.3 Minimum Age Requirements

Minimum age requirements may apply to certain sailings, special sailings, or promotional fares. These requirements are established by the cruise line and will be communicated at the time of booking.

6. SPECIAL REQUIREMENTS AND CONDITIONS

6.1 Pregnant Passengers and Infants

If you or a guest is pregnant or traveling with an infant child, you must notify us in writing. We will communicate these needs to the cruise line as some cruise lines have restrictions on pregnant passengers or infants, particularly regarding sea days and length of cruise. We will do everything we can to accommodate your needs and answer all your questions.

6.2 Medical Conditions and Physical Challenges

If there is a need to communicate special requests for medical conditions, physical challenges, mobility requirements, or accessibility needs, you must notify us in writing prior to booking or immediately after booking. We will do our best to notify the cruise line of these needs and to facilitate appropriate accommodations. However, cruise lines make final decisions regarding accommodations and accessibility features.

6.3 Special Meals and Dietary Restrictions

Special meal requests (vegetarian, kosher, halal, allergies, etc.) must be communicated in writing. We will relay your requests to the cruise line. Cruise lines typically request 30 days advance notice for special meal accommodations. Failure to notify the cruise line in advance may result in limited or unavailable meal options onboard.

7. REFUNDABLE RATES

"Refundable Rate" applies only to the deposit portion of the cruise fare, not the entire cruise cost. The cruise must be cancelled prior to the applicable cruise line's Final Payment deadline to qualify for a refund of the deposit. Deposit does not include any applicable processing fees.

Other restrictions and cancellation penalties may apply. Refundable Rate Offer does not apply to:

  • Chartered sailings

  • Contracted group bookings

  • Any sailing with special restrictions or terms

8. CANCELLATION POLICY

8.1 Supplier Cancellation Terms

Cancellation policies are determined by individual suppliers (cruise lines, hotels, airlines, etc.). Each has its own cancellation terms, penalties, and deadlines. We will provide supplier-specific cancellation terms in writing at the time of booking.

8.2 Traveler-Initiated Cancellations

If you cancel your travel arrangements, refunds (if any) are determined by the supplier's policies and the timing of your cancellation request. Refunds will not be issued if cancellation occurs after the supplier's deadline. Service fees charged by Travels with Kirstie are non-refundable.

8.3 Cancellation Deadlines

You are personally responsible for meeting all cancellation deadlines. Late cancellations may result in forfeiture of all deposits or full payment. We strongly recommend travel insurance to protect against unexpected cancellations due to illness, emergency, or other circumstances.

8.4 Supplier Refund Processing

Refunds from suppliers may take 30-60 days or longer to process. We are not responsible for delays in refund processing by suppliers.

9. TRAVEL INSURANCE

Travel insurance is highly recommended to protect your investment against cancellations, medical emergencies, lost luggage, flight delays, and other travel disruptions. We can assist you in selecting appropriate coverage, but you are ultimately responsible for understanding policy terms and coverage limits. Insurance must typically be purchased within 14 days of your initial trip deposit to qualify for coverage of pre-existing conditions.

10. CHANGES TO ITINERARIES

Suppliers may modify itineraries, accommodations, or services without notice. While we will communicate material changes when possible, we are not responsible for modifications made by suppliers. Price adjustments may apply for changed services. Cruise lines reserve the right to substitute ships, alter itineraries, or change ports of call.

11. LIABILITY AND DISCLAIMERS

11.1 Limited Liability

Travels with Kirstie acts as a booking agent for suppliers. We are not responsible for the services provided by airlines, cruise lines, hotels, tour operators, or other suppliers. We do not operate or control transportation, accommodations, or activities.

11.2 Supplier Liability

All services are subject to the terms, conditions, and liability limitations of suppliers. Each supplier limits its liability as permitted by applicable law. We cannot accept liability for supplier negligence, service failures, accidents, injuries, losses, or delays.

11.3 Force Majeure

Neither party is liable for losses or delays caused by events beyond reasonable control, including natural disasters, weather, war, terrorism, strikes, government actions, pandemics, or other unforeseeable circumstances.

11.4 No Warranty

Travel services are provided "as-is" without warranties of any kind. We do not guarantee supplier performance, quality of accommodations, weather conditions, destination experiences, or any particular results.

12. PASSENGER RESPONSIBILITIES

You are responsible for:

  • Ensuring valid passports, visas, and travel documents for all passengers

  • Meeting all supplier check-in and departure requirements and deadlines

  • Complying with all applicable laws, regulations, and health requirements

  • Obtaining required travel insurance, vaccinations, and medical clearances

  • Informing us of special needs, health conditions, medications, or mobility requirements in writing

  • Protecting your travel documents and valuables

  • Following supplier rules, regulations, and codes of conduct

13. COMMUNICATION

We communicate via email, phone, and social media. It is your responsibility to check messages and confirm receipt of booking confirmations and important updates. Changes to your contact information should be provided immediately. Failure to respond to important communications may result in automatic cancellation of your reservation.

14. PRIVACY AND DATA PROTECTION

Your personal information is collected and used to process reservations, communicate with suppliers, comply with legal requirements, and provide customer service. We do not share your information with third parties except as necessary for travel arrangements. Please refer to our privacy policy for details.

15. DISPUTES AND COMPLAINTS

If you have concerns about your travel arrangements, notify us within 30 days of your travel completion. We will work with suppliers to resolve legitimate complaints. Unresolved disputes may be subject to arbitration or the laws of California.

16. CALIFORNIA SELLER OF TRAVEL NOTICE

Travels with Kirstie is registered with the California Department of Consumer Affairs as a Seller of Travel, Registration #2172267-70. 17. GOVERNING LAW AND JURISDICTION

These Terms and Conditions are governed by the laws of the State of California, without regard to conflict of law principles. Any legal action must be brought in the appropriate court located in California.
